Motor Accident Compensation Case

Overview

This case concerned a severe road accident in which our client, a 32-year-old employee, sustained multiple fractures and long-term mobility limitations after being struck by a speeding commercial vehicle. The legal action was initiated under the Motor Vehicles Act Section 166, along with criminal liability under IPC Section 279 and Section 338 for rash and negligent driving. The insurance company attempted to reduce its financial responsibility by rejecting medical reports, questioning the FIR details, and minimizing the disability assessment. Our primary objective was to establish negligent driving, prove the medical and financial impact, and secure full compensation as per the relevant statutory provisions.

Solution

To resolve these issues, we conducted a complete accident reconstruction using CCTV footage, FIR entries, and expert technical analysis, proving beyond doubt that the commercial vehicle was fully responsible. A government medical board examination was arranged to authenticate the permanent disability certification, outweighing the insurer’s objections. We filed a detailed petition under Section 166, supported by medical evidence, witness depositions, and financial verification documents obtained from the client’s employer and bank statements. Eyewitness accounts were secured to eliminate the claim of contributory negligence. We ensured every component of the client’s compensation—medical costs, future treatment, disability impact, mental anguish, and income loss—was supported by strong legal and factual documentation.

Challenge

The main challenge arose when the insurance company argued that the disability percentage certified by the treating doctors was not sufficient to qualify as permanent disability under the Motor Vehicles Act. The opposing party falsely claimed contributory negligence and attempted to shift responsibility onto the victim. Several important documents such as the initial accident diagram, extended medical notes, and traffic signal timing records were missing or incomplete in the police investigation file. Verifying long-term loss of earning capacity was also difficult because the client did not have continuous documented salary proof.

Result

The Motor Accident Claims Tribunal ruled entirely in favor of our client, acknowledging permanent disability, medical expenses, future rehabilitation needs, emotional suffering, and substantial loss of earning capacity. The insurance company was ordered to release the full compensation amount with interest for the delay. The judgment reinforced liability under the Motor Vehicles Act and confirmed that all objections raised by the insurer were unjustified. This case stands as one of our most significant accident-law successes due to the precise reconstruction of evidence, clear establishment of negligence, and strong legal presentation.
